01Your agreement with Thinair

You accept these terms when you create an account or purchase a service that links to these terms. You must be at least 18 years old and able to enter into a binding agreement.

If you act for an Organization, you must have authority to accept these terms for that Organization. A separate written agreement with Thinair controls any conflicting provisions for the services that it covers.

02Accounts and Organizations

You must provide accurate account information and protect your credentials. You are responsible for actions that you authorize through your account, including actions by agents and integrations.

Organization administrators control membership, permissions, and shared resources. Content that you place in an Organization can remain available to that Organization after your membership ends.

Contact Thinair promptly if you discover unauthorized account access. Thinair can restrict access to protect an account or investigate suspected misuse.

03The service and your work

Thinair provides software and computing resources for people and AI agents. Features can differ between Native, Cloud, and your plan. Early-access features can change or become unavailable.

You retain your rights in the content that you provide. You give Thinair permission to host, copy, process, and transmit that content to provide the services that you request.

This permission includes service providers and collaborators that participate in your requested workflows. It does not transfer ownership of your content to Thinair.

Thinair and its licensors retain their rights in the service. Subject to these terms, you can use the service for its intended purpose. Separate open-source licenses continue to govern the components that they cover.

04AI agents and connected services

An agent can run commands, edit files, and act through connected accounts within the access that you provide. You must choose appropriate access and review consequential actions and results.

AI output can contain errors, omit facts, or resemble output produced for other users. Thinair does not guarantee that output is accurate, unique, or suitable for a particular purpose.

Third-party software, AI providers, and connected services have their own terms and privacy practices. You are responsible for permission to use the accounts, software, and content that you connect.

05Acceptable use

You must use the service lawfully and respect other people’s rights. You must not use it for fraud, malware, unauthorized access, harassment, or unlawful content.

You must not bypass access controls, interfere with other users, or conceal activity that violates these terms. Security research requires authorization from the owner of each affected system.

You must not use the service where an error can directly cause death or serious injury without independent safeguards appropriate to that use.

06Subscriptions and payment

The pricing page and checkout describe the plan, currency, price, billing period, and included features. Checkout shows the amount due before you authorize a payment.

Subscriptions renew automatically each month until canceled. You authorize Stripe, our payment processor, to collect the subscription amount and any applicable taxes through your payment method.

Organization subscriptions charge for billable Members. Guests do not require a paid seat. The service shows the price effect before you confirm an action that adds paid seats.

A subscription starts after successful payment and account activation. You can manage your subscription and payment method through Billing.

If a payment fails, Stripe can retry it. Unresolved payment failures can restrict paid features. You remain responsible for valid charges that arose before cancellation or restriction.

Thinair will give advance notice of changes to recurring subscription prices. A new subscription price applies to a future renewal, as stated in that notice.

07Prepaid usage credits

Where available, paid Machine and hosted AI usage draw from a separate prepaid credit balance. A subscription does not include usage credits unless the offer expressly says so.

The account that owns the work pays for its usage. Personal and Organization balances remain separate. Usage rates appear in the service before you authorize the work.

Credits do not expire. They are service credits, not a bank account, transferable currency, or an investment. Credits have no cash redemption right except as required by law or an approved refund.

Automatic refill is optional. If you enable it, you authorize purchases using your selected threshold, purchase amount, and payment method. You can disable automatic refill through Billing.

An optional monthly limit applies to automatic credit purchases. It does not limit manual purchases or use of credits already in your account.

If the account lacks sufficient credits, new paid work can stop or fail to start. Retained storage can continue to incur charges at the disclosed rate after compute stops.

Cancellation of a subscription does not itself remove stored data or stop all chargeable resources. You must manage those resources separately. Feature availability and storage retention follow the conditions shown in the service.

08Cancellation and refunds

You can cancel a subscription through Billing before its next renewal. Cancellation stops future renewals. Paid subscription access continues through the current paid period unless another provision requires restriction.

Cancellation does not automatically refund the current subscription period. Unused credits and completed usage are not automatically refundable. Rights that applicable law gives you still apply.

Contact Thinair about duplicate payments, incorrect charges, or a service problem that prevents the purchased service. Include enough information to identify the charge, but do not send complete payment-card details.

Thinair reviews refund requests individually and corrects confirmed billing errors. Approved refunds return through the original payment method where possible. The bank or payment provider controls when the refund appears.

09Service restrictions and account closure

Thinair can restrict or end access for material violations, unpaid charges, security risks, or legal requirements. Where practical, Thinair will explain the restriction and allow you to correct the problem.

You can request account closure through the contact address at the end of these terms. Account closure and subscription cancellation are separate from removal of shared Organization content.

You are responsible for copies of work that you need to retain. Thinair does not promise indefinite storage after a resource or account ends.

10Service limits and responsibility

Thinair provides the service on an as-available basis. To the extent permitted by law, Thinair disclaims implied warranties of merchantability, fitness for a particular purpose, and noninfringement.

Thinair does not guarantee uninterrupted service or recovery of every file or action. These terms do not replace any express promise in a separate agreement.

To the extent permitted by law, neither party is liable for indirect or consequential losses, lost profits, or lost business opportunities.

Thinair’s total liability arising from the service is limited to the greater of $100 or your payments to Thinair during the preceding 12 months.

These limits do not exclude liability for fraud, willful misconduct, or any liability that applicable law does not permit the parties to limit. Your nonwaivable consumer rights remain intact.

11Changes and contact

Thinair will post updated terms with an effective date. For material changes, Thinair will give notice through the service or the account email before the changes take effect.

Changes do not retroactively alter a dispute that arose before their effective date. If applicable law requires new consent, Thinair will request it.
